The Salaries and Allowances Tribunal has issued a determination with respect to the eligibility of Ministers and certain other officeholders to receive the Motor Vehicle Allowance, as specified in Part 5 of the Members of Parliament Tribunal Determination No. 2 of 2016, issued on 1 December 2016.

The Tribunal's decision to provide a motor vehicle allowance to all Members aimed to enable Members to address their particular motor vehicle requirements and remove the burden on Government to provide Members with private plated, leased vehicles. 

Under arrangements that are separate to the Tribunal, Ministers and certain officeholders are provided a vehicle.  The Tribunal has been advised that these arrangements will be maintained, creating the unintended result of a second vehicle entitlement for some Members of Parliament.  

This variation to the Determination will prevent Ministers and certain officeholders from accessing the Motor Vehicle Allowance. An officeholder, such as those representing regional areas, may apply to the Tribunal to receive the Allowance for use predominantly in their electorates.


Members of Parliament Tribunal Determination No. 2 of 2016, made on 1 December 2016 under sections 6(1)(a), (ab) and (b) of the Salaries and Allowances Act 1975, as amended from time to time, is hereby varied by a further determination set out below. 

This variation is effective on and from 18 May 2017.

Insert the following after section 5.1(6) in Part 5 of the Determination –

Application to Certain Officeholders

7.   Subject to section 5.1(8), this Allowance is not provided to a Member who has been appointed to an office for which a   Government vehicle has been supplied under arrangements separate to this Determination. 

8.   A Member who is appointed to an office for which a Government vehicle is supplied under arrangements separate to this Determination may apply to the Tribunal to receive this Allowance.  An application under this subsection must certify that the Allowance will be used in relation to motor vehicle requirements predominantly in the Member's electoral region or district.
